1. Definitions & Agreement to be bound

 

1.1 Definitions

References to “us,” “we,” and “our,” means COBBLE CRAFT Pty Ltd, and/or The Cobblers.

References to “you,” and/or “user” mean the Customer/general user of the website.

 

1.2 Agreement to be bound

The information set out on the website, including any features/services available and other materials, are subject to the Terms and Conditions set forth below. Please read them carefully, as any of use of the website constitutes an agreement, without acceptance, to be bound thereby by you, the User. By using the website, you agree that you are at least eighteen (18) years old, have read and understand the Terms and Conditions, and that you agree to be bound by these Terms and Conditions, as set forth below.

 

2. Delivery

2.1 COBBLE CRAFT Pty Ltd/The Cobblers will endeavour to get your item(s) back to you, repaired, as soon as possible - however, we cannot always guarantee delivery by a particular date. We will inform you when your item(s) have been repaired and are on the way back.

 

2.2 We will endeavor to adhere to any delivery dates stated and/or agreed to, but cannot guarantee that item(s) will be delivered by such a date. COBBLE CRAFT Pty Ltd/The Cobblers shall not be liable for failure to deliver at such stated date.

2.3 We will only consider any claim made by a customer for the supply of a defective repair within fourteen (14)  days of the delivery of the item(s) to the Customer.

2.4 COBBLE CRAFT Pty Ltd will not be held responsible for any loss or damage of items after we have sent them back, and received a receipt from Australia Post as proof. Although we will do everything within our power to retrieve lost items, we accept no responsibility on behalf of Australia Post.

 

2.5 Where the customer specifies an incorrect delivery address, COBBLE CRAFT Pty Ltd will not be held responsible for any loss or damage to the item(s). Please double-check all details are correct before submitting. 

 

3. Liability & Indemnity 

 

3.1 COBBLE CRAFT Pty Ltd accepts no liability whatsoever for any loss or damage whether consequential or direct and whether suffered by or occasioned to the customer, the employees or agents of any customer or third party which may arise after delivery of shoes to the Customer.

3.2 The Customer shall indemnify Cobble Craft Pty Ltd against any loss, liability, or expense of any kind, suffered by Cobble Craft Pty Ltd resulting from any third party claims, whether contractual tortious statutory or otherwise, against Cobble Craft Pty Ltd in connection with the Customer’s item(s).

3.3 In the event that we do not receive item(s) within thirty (30) days of postage label being sent, or we are unable to successfully deliver a customers item(s) due to no fault of our own/the couriers/Australia Post, within thirty (30) days of completing the repair, the Customer forfeits any rights to refund, or possession and ownership of the item(s), respectively.

4. Repairs

 

4.1 Cobble Craft Pty Ltd will do everything within its power to ensure the repair lasts, going beyond what is necessary, such as several coats of glue on certain materials. As different shoe manufacturers sometimes use certain chemicals in their materials, it is not guaranteed that such chemicals will not have an adverse effect on the glue that we use. We cannot guarantee the repair of item(s) with irreparable defects, or guarantee the repair of item(s) with defects not brought to our attention prior to us receiving them.

4.2 All repairs - In a situation where we have to make the decision of choosing aesthetic appeal or durability, we will always choose the latter. We will try to colour-match the original materials as closely as possibly, but cannot always guarantee an exact match in colour, tread, density, or thickness. We will always choose the material we deem to be most suitable for your item(s).

4.3.1 Clean/Polish - We cannot guarantee complete removal of stains/marks from leather/suede. Some stains are harder to lift than others. However, we will try our best to get the item(s) looking as good as they possibly can. When cleaning suede, there is a slight possibility that it may discolour. Though we will take every precaution, sometimes this is unavoidable, as it depends on the types of dyes the manufacturer has used, and whether or not have been sealed properly afterwards. The risk of discolouration has been clearly stated within these terms and conditions, and remains the sole responsibility of the Customer.

4.3.2 Shoe/Boot Stretching - Although most materials will stretch somewhat, we cannot always guarantee that stretching will rectify your initial problem. We can generally stretch shoes/boots up to half a size, but it is not a guarantee, and some materials have been known to shrink back over time.

 

4.3.3 Combo Deals - We reserve the right to decide if Combo Deal selected by the User is sufficient in fixing overall problem. If Mini-Makeover has been selected, but major work has to be done, we may increase the price of the overall repair.

 

4.3.4 Buckles/Elastics - Although we will always try to match elastic and buckles - thickness, shape, size, and colour - we can not guarantee that it will be perfectly identical to the original.

4.4 Please inspect your item(s) immediately upon receipt, and notify us within 48 hours if you have any complaints, concerns or questions regarding the repair Our repairs are guaranteed for a period of ninety (90) days, with the exception of zip repairs, and cleaning/polishing. You may return the item to us during this period at your own expense, at which point we will attempt further repairs, and then return the item to you at our own expense. If we decide that the item is irreparable, a refund up to a maximum of the amount you paid us for the repair will be issued, minus postage. We will not be held responsible for any other loss or damage (such as the cost of replacement or the cost of not having the item available to you for any period of time).

 

5 Payments 

5.1 The price given online may not correlate with the extent of the work involved in the actual repair, and may be subject to change upon inspection of the item(s). We will not carry out a repair if we don’t think it will last, and/or more work is needed that originally specified.

5.2 Cobble Craft Pty Ltd shall be responsible for determining the final price of repair upon inspecting the item(s). If, upon inspection of the item(s), the actual price of repair is more than quoted online, you will be required to pay the difference. If you then choose not to go ahead, you will receive a refund of the cost of the initial repair, minus postage. If, for whatever reason, we deem your item(s) irreparable upon inspection, you will receive a refund for the repair, minus postage.

6.  Refunds 

​

6.1 We at COBBLE CRAFT Pty Ltd/The Cobblers will try our best to carry out repairs to meet , and exceed, your expectations. Before returning your item(s), we will send a photograph or the completed repair. By replying “yes” to the email, you accept that you are satisfied with the repair, and they are ready to be sent back. 

 

6.2 In the unlikely event that a repair should fail, if still within fourteen (14) day cool-off period, the customer should send the item(s) back, and we will reimburse for the postage. However, if it has been more than fourteen (14) days, and less than thirty (30) days since the Customer received item(s) back, customer must pay of postage. We will rectify the repair for free, unless an unforeseen defect arises. If it has been longer than thirty (30) days since Customer received item(s) back, the repair is no longer in warrantee period, and what happens next remains at our discretion.

 

7. Modifications and Changes to Terms and Conditions

By using this website, you are accepting the Terms and Conditions within this document. We may modify, add to, suspend or delete these Terms and Conditions ,or other agreements, in whole or in part, in our sole discretion at any time, with such modifications, additions or deletions being immediately effective upon their posting to the website. We may additionally attempt to notify you of such changes by contacting you by email. Your use of the website after modification, addition or deletion of these Terms and Conditions shall be deemed to constitute acceptance by you of the modification, addition or deletion.
